What's the status of Legalized Medical Marijuana in Florida?

On November 8, 2016, Amendment 2 passed and many more of Florida’s patients will soon qualify for medical cannabis. Right now, a few patients in Florida have been legally able to obtain medical marijuana but only if they had very severe, terminal illnesses and were not expected to survive more than a year. Low-THC medical marijuana is available for a few patients with severe seizures and cancer. The current restrictions on the dispensing of Medical Cannabis under the current laws are quite severe and it is quite difficult to prescribe and obatin medical marijuana. Hopefully the law will be revised in the coming months by the Florida State Legislature to make it more practical and allow doctors to prescribe the treatments the patients want and need. 

Here’s what will happen next. First, it will go to the Florida Legislature. Amendment 2 will have to be implemented by the State Legislature. Current law requires a 90-day waiting period and third-party certification of a doctor who recommends medical cannabis. The Legislature may make everyone follow the current rules, or they may change or eliminate some rules. It is yet to be determined.

If you are a current or potential patient, or a physician,  making your voice heard by your representatives in the Legislature during this process is the best thing you can do to advocate for your wellness options. Call or email your local Florida Senator or Representative and let them know how you would like to see Amendment 2 implemented. The people of the state spoke at the ballot box on November 8 when Amendment 2 passed with over 70%. It is now important that the representatives in the legislature honor the wishes of the people and implement a practical, simple set of rules so the sick and suffering patients can obtain the treatments they want and need. 

Then it will go to the Florida Department of Health (DOH). DOH’s Office of Compassionate Use regulates medical cannabis. All patients need to make sure that the cannabis they are using is from an organization licensed and approved by DOH. It is the Department’s job to verify the content of cannabis products used by patients. In addition, if the Legislature delays or decides not to create the rules to implement Amendment 2, then it will go to the DOH to implement Amendment 2 by July 1, 2017.

The final Medical Marijuana Laws have not yet been written in Florida! The amendment passed but the detailed laws need to be written. Please contact your state politicians in Tallahassee and keep the pressure on them to make sure they listen to the voters and make medical cannabis convenient,  practical and available for the patients in Florida who need it!
